As the development of global economics and international finance, financial derivatives have been most energetic and effective financial product. Financial derivatives trade is based on traditional financial derivatives trade, but it is more competitive. A good financial derivatives trade becomes the signal of maturity of a financial derivatives trade market of a country. However, financial derivatives in promoting the development of financial globalization, as well as risk the possibility of the accumulation, and the tremendous risk of growing importance to the regulatory agencies. Competition on China's OTC financial derivative market and the characteristics of this market are asking for improvement upon legal system. However, such an improvement got quite limited support from legal theory, especially in legal system of supervision. Therefore author decides on the title, "Legal Research of Supervision on Financial Derivative Markets—To OTC financial derivative transactions as the main analytical perspectives " for research.Viewing from legal theoretical aspect, in comparative, empirical and historical analyzing-ways, this paper tries to make a relatively comprehensive analysis on such topic. This paper is divided into introduction, body and conclusion in three parts. This paper consists of four Chapters. Chapter One divide the types of financial derivatives from the basics of financial derivatives, summarize its legal characteristics. In recent years an important financial derivatives risk event as an entry point, focused on the risks of financial derivatives and the main features of the risk. Chapter Two regulation of financial derivatives is a discussion of the legal system, regulation of financial derivatives, introduced the theoretical basis and regulatory systems, as well as financial derivatives market access, trading, delisting of the relevant control systems; Chapter Three mainly concerns Legal Research of Supervision on OTC Financial Derivative; firstly, financial derivative is defined as a concept parallel with commodity derivative. The following is chief introduction on its legal characteristics and basic categories. Followed by its legal characteristics of a brief summary and market introduction, and then by the developed countries, developing countries and international regulatory organizations, the regulatory regime compared to sum up experiences and propose reasonable measures for improvement Chapter Four is the legal perspective on developing China's financial derivative market. The present status in China is quite in a mess, so it is necessary as well as practical to develop the financial derivative market in China. The author further points out the feasibilities of developing the financial derivative market and concluded with the proposals on the legal regime and related systems.
