Since Qing dynasties, the special role of overseas Chinese has made a unique contribution to their home country's social development and nation-building. However, their vagrant identities and ethnic characteristics have created many obstacles to their overseas'survival, some of them even have free emotion between identity recognition and identity return. As we all known, most overseas Chinese have no political rights in the country, and thus they cannot obtain the identity as the resident of the country to seek normal interest.The foundation of the republic has arouse overseas Chinese enthusiasm of political participation. But the process of overseas Chinese demanding political right has gone through many twists and turns, especially criticized by the others for the legal defects and the possible international conflict initiated by those defects, and all of these have become the main obstacles in their access to the political rights . When faced with the choice of their own real interests, the Chinese showed its perseverance character, and fully mobilized the support from all parties in domestic, to seek their political rights service. From the overview of the requirement of overseas Chinese political rights, we can see that besides their own interaction, they have weighed the interests of domestic-related groups and taken some political considerations. It is difficult to deny that the unique role of overseas Chinese in the modern countries'nation-building is obviously the key solution in win the fight for political rights.This thesis treats the discussion of the first congress of provisional senate in 1911 years to 1913 as the main temporal and spatial clues, and trying to make a panoramic description and interpretation based on the following aspects:the proposition of political rights, the legal system they faced, other people's controversy on their demanding of political rights, the final establishment of their rights, the specific operation and effects of overseas Chinese election. Meanwhile, this thesis also aims to enclose the way of Chinese constitution of early republican period by comparing some aspects of overseas Chinese struggle for political rights with the fight for rights of some Mongolian and Tibetan representatives , based on these we will explore the political aspirations of domestic and foreign special interest groups, the government's response, and their historical reasons in the process of political transition in the early Republican period .
