Due to the lack of guidance from law concept, the technical reconnaissance of China's public security organs is simply interpreted as a secret and effective means for investigating and solving legal cases. As a result, technical reconnaissance is characterized as"national secret"and complete"mystified". It is such"mystification"tendency that leads to many issues for the related provisions of China's technical reconnaissance, in terms of its applicable conditions and targets, application procedures, usage of evidence information, as well as the rights and relief of involved parties. The author believes that technical reconnaissance is a special investigative measure, which needs to be strictly regulated, since it involves national criminal justice and ethics. It cannot be classified in the traditional sense of compulsory investigative measures. Therefore, the legal regulation of technical reconnaissance cannot be simply based on the understanding of compulsory investigative measure. Instead, technical reconnaissance needs well-targeted regulation based on its own characteristics.
