Influenced by the social ideology, the Chinese legal institutions on lost property are too simple in regulations and impractical in operation. By comparing and contrasting the corresponding laws on lost property in the ancient and modern China and those in other countries of contemporary world, the author expects that some improvement in the ongoing formulation of the corpus of Chinese civil law can be achieved in terms of lost property. The novelty of the research lies in three aspects: First, in addition to the exploration of the continental legal system, the norms of both British and American property laws are analyzed and discussed. Second, the research not only observes and studies the contemporary oversea legal institutions on lost property, but also dates back to the ancient times to approach the origin of laws. Third, while the evolution of the provisions of the Chinese ancient books and records concerning the laws on lost property are investigated, the customary laws , which has existed as a matter of fact, of the oriental empire, who has a long history and is characterized by huge areal variation, and their impact on lost property laws are explored when it comes to civil laws. With extensive and deep exploration of the concerning research materials, the author creatively draws convincing conclusions and offers constructive suggestions as to the approach to perfect the Chinese lost property laws.
