This paper compares the management systems of the local employees working for foreign embassies and consulates in China and abroad and introduces the current situation of the protection of the labor rights for the Chinese employees working for foreign embassies and consulates in China (hereinafter referred to as Chinese employees). From the management systems in China, the principle of diplomatic immunities and privileges adopted by Chinese government, the lag of legal construction on protection of the labor rights for the Chinese employees, it analyzes the reasons why the labor rights of the Chinese employees are infringed and the protection of the labor rights for the Chinese employees encounters difficulties in reality. Then, it raises suggestions, including legalizing the Centralized Management Policy, revising and improving the current laws and regulation on labor rights and social security, establishing the procedures for dealing with the labor disputes, unifying the nature of the diplomatic service organizations, adopting limited immunity principle, pushing forward the new agreement for using the Chinese employees by foreign embassies and consulates in China, strengthening communications and enhancing mutual understanding and trust, and establishing the insurance fund of compensation for the victims.
