Study On The Anti-circumvention Under Anti-dumping Law

With the continuous development of international trade, the circumvention of anti-dumping measures are increasing day by day, and the way to circumvent also changes frequently.All these factors prompt the research on Anti-circumvention becoming a hotspots to every country. The United States is a forerunner of anti-circumvention legislation and anti-circumvention practice,in the 80s of last century, the United States enacted anti-circumvention provisions. In the past 20 years, the United States has accumulated rich experience in legislation and practice, so American anti-circumvention legal system becomes an important object of our research.And it also will be will be an indispensable reference to our future anti-circumvention legislation.Our Anti-dumping legislation and practice is imperfect, anti-circumvention legislation as Anti-dumping legislation's extension and development,it is too simple and crude to meet the need of reality. In the context of China's Total volume of trade continuously rises, the above factor will undoubtedly hinder the continuously steady growth of our economy. Therefore, as soon as possible to improve the anti-circumvention legislation is imperative.This paper first discusses some theoretical problems which is relative to anti-circumvention, and then select the U.S. anti-circumvention system as our research object, and finally it discusses U.S. anti-circumvention circumvention system's inspiration to the construction of our anti-circumvention circumvention system.
