The Research On The Anti-circumvention Problem Of Anti-dumping Law

As the new development of anti-dumping law,the effect of anti-circumvention measures is becoming stronger and stronger. Beginning from the basic theories of anti-circumvention problem, this article analyses the concept of circumvention,the legal nature of circumvention and anti-circumvention measures and the characteristic of anti-circumvention measures. The article introduced the legal sources and contents of the anti-circumvention laws of both European Community and USA,and gives the comments on these rules.After introducing the history of anti-circumvention laws of GATT(WTO),this article then introduces and analyses the related anti-circumvention contents in Dunkel Crafts.According to the talks on anti-circumvention topic in WTO,the article analyses the future laws in WTO and the possible function of China.With the reference to the anti-circumvention laws of European Community,USA and WTO,the article analyses the present anti-circumvention laws of China and offers the advices to improve them.
