Research On The Certain Legal Matters Of Agricultural Product Quality Safety

"Law of the People's Republic of China on Agricultural Product Quality Safety" promulgates to execute in November,2006, has made our country's agricultural product quality safety problem realize truly that there are laws to go by, has provided the legal safeguard for our country agricultural product quality safety problem's solution as well as the agricultural product quality safety level's enhancement. But, the agricultural product quality safety problem involves the multi-domains, the multi-level and the multi-disciplinary complex topics. Speaking of the legal stratification plane, the solution agricultural product quality safety problem needs us to form a covering extensive fields, the link to thread up, mutually supporting and harmonious developmental agricultural product quality safety legal system.This article consists of three parts.The first part is "the relevant concepts and legislation outline about the quality safety of agricultural products".This part analyzes the agricultural products.the edible agricultural products.agricultural products quality safety and other related concept, then introducts that the coutry attaches importance to the agricultural product quality safety legislation, regulations and improve the quality and safety of agricultural products.The second part is to compare among Law of the Agricultural Product Quality Sefety, Product Quality Law and Food Safety Law. It analysis that they have their own objects and scopes of application,these laws are the parallel relationships.But diffenrent "products" are not the same as the applicable laws.The third part is about the agricultural product quality safety legislation system improvement. This part analyzes the current Law of the Agricultural Product Quality Safety about its principles of safety responsibility, agricultural product quality safe supervision, agricultural product quality standard of security and habitat environment.Based on the analysis of the system deficiencies and problems,it makes recommendations to improve the legal system.
