On The Criminal Protection Of Citizen Personal Information Protection

Social informatization is becoming a trend, and the wide use of computers and the Internet has changed the mode of people's life greatly.Though modern science and technology can greatly improve the efficiency of collection, processing, and utilization of personal data and information transmission, it also increases the possibility that the personal information may be infringed. Legislation to protect personal information emphasize the value of citizen's information freedom, highlights the human-oriented idea, and responses to the appeal for a harmonious society. The Chinese government also put the personal information protection in the legislative plan. However,the legal protection of personal information is a new emerging field and there are still lots of different points of views on definition of personal information,scope of protection and protected mode.This thesis explores the basic theory on personal information,analyses the present situation and deficiency of personal information protection, and proposes some suggestions on the protection of personal information.Paper's Framework:the first part is about the definition of personal information, traits, rights and contents about personal information; the second part is about the analysis on the protection of personal information, legitimacy and necessity of the criminal protection system of personal information; the third part is about the comparison between different legal systems, mainly about the advantage and disadvantage of personal information protection of different legal systems; the fourth part is about the present situation,deficiency and meaning of personal information in China; the fifth part is about how to protect the personal information right and suggestion on legislation in this field,mainly based on Criminal law amendment (7).
