This thesis is about the thinking about the behavior of making or distributing Trojan Horse from the view of criminal law. The behavior of distributing Trojan Horse, such as Hanging Horse, has disturbed our usual lives in the internet, so that, we have to protect the net citizen from the harm of the problems.After studying the books of professor H.L.Packer, who is an American, and professor Zhang Mingkai, who is a Chinese, I decided to talk about what means we can use to ban the behavior of making or distributing Trojan Horse from the view of "the damage caused by the behavior of making or distributing Trojan Horse ", "the methods of forbidding the behavior of making or distributing Trojan Horse in the law system is not enough" and "the new methods of banning the behavior of making or distributing Trojan Horse can be used"The main body of this essay has been divided into four parts, which include five chapters.The first part of the article is the INTRODUCTION. In this part, I use the theory of psychology to talk-about the reason of banning the behavior of making or distributing Trojan Horse.The second part of the article includes chapter one and chapter two. I list the damage caused by the behavior of making or distributing Trojan Horse in this part to demonstrate that we have to ban the behavior. The third part of the article includes chapter three and chapter four. In this part, I prove that the criminal law and civil law and administrative law are not enough for us to forbid the behavior of making or distributing Trojan Horse, which is the reason why we can not have a comfort network environment.The fourth part of article includes chapter five. In this part, I advise that we can design two new charges against the behavior of making or distributing Trojan Horse, which is also proved to be compatible in our criminal law.
