| After the research in southern part of China in 2010, the vice president Zhang, Dejiang required the relevant authorities to restart the legal process of Shipping Law. International Liner Shipping is one of the most important parts in the Shipping Law. It is necessary to make a study on the International Liner Transportation, especially the theory on the International Liner Shipping Agreement, thus making Shipping Law better serve development of shipping industry. This thesis will take this opportunity to make some illustration and analysis on the International Liner Shipping Agreement. Suggestions and opinions will be posed, in hope of giving some clues in legislation of Shipping Law.The thesis will be divided into four parts. The first part is the basic theories of the International Liner Shipping Agreement. The author will pose some standards for identification of such Agreement. And the characteristics will be discussed. The second part is the impacts that International Liner Shipping Agreement will have which serve as preparations for following contents. The third part will discuss the legal validity of the Agreement. The author will make comparison and analysis based on the different practices in the USA and the EU, and then come to conclusion of attitude that China should take. The fourth part is the suggestions on the construct and perfect of Chinese legal system on International Liner Shipping. Legislation is urgently needed. In addition to concrete measures, legislative model, principles as well as range of application should also be taken into consideration. This is the pre-requisition for operability of Law. Personal opinions will be posed at the end of the thesis. |
