The question of Terminal Handling Charge(THC)is an important matter which not been solved yet.The controversy of THC has never stopped from 2002 to 2015.During this time,Chinese authorities had made an investigation into whether illegal activities exist in collection of THC but produced very little effects.This dissertation combed the development of THC controversy in China first.The perspective is not limited to the legal attribute of THC,but from the perspective of competition in shipping market.By analyzing the basic theory of competition law,this dissertation discusses the validity of THC under competition law.Finally analyze the influence of THC problem to shipping competition of our country and puts forward some corresponding suggestions.Besides Preface and Conclusion,this dissertation is divided into 4 chapters as follow:Chapter 1 is an overview of shipping competition law.The main content is the relation and distinction between shipping competition law and general completion law,and the legislative status quo of shipping completion law in China.Chapter 2 overall expounds the THC controversy,including the concept of THC,differences between THC and other shipping costs,causes of THC controversy,and the development of THC controversy in China.Chapter 3 starting from the basic rules of completion law,discuss the behaviors of eliminate or restrict completion that may exist in the process of collection THC from perspectives of price cartel,abuse of dominant market position and relative advantage position.Chapter 4 discusses current management status to THC of our country,the legal causes of THC controversy and puts forward reasonable settlements on solving the controversy.
