The Copyright Problems About Collection Resources' Digitization And Upload

Digitization and upload of collection resources are different from the ways of traditional libraries when using a work. Such new modes intensifies the conflict between not only the copyright protection and information resources sharing,but also the copyright owners and the digital libraries of the universities,which thereby lead to the dilemma of copyright authorization problems into which the digital libraries of the universities are trapped. In order to solve this problem,we should discuss it from both theoretical and institutional perspectives. For one thing, the copyright system is theoretically consistent with the digitization and upload of collection resources as for the value choice; For another,when applied to the digitization and upload, the current copyright system has its inherent limitations, such as the inapplicability of the judgment rules of reasonable use, and the absence of copyright limitation system in the digital environment. In order to realize the legalization and standardization of the collection resources' digitization and upload, we must improve the copyright system, such as to clarify the core of copyright limitation system, to determine the principles of application of copyright limitation system, to prescribe the types and scope of reasonable use in the digital libraries of the universities, to adjust the judgment rules of reasonable use, to establish statutory license system of the digital libraries of the universities, to improve the copyright collective management system, and to regulate the adoption of technology protection measures.
