Copyright Statutory License System Research

China's copyright statutory license system after the repair,but has been unable to meet the requirements of human rights,also failed to reduce the work license cost,this point and third times in the current "copyright law" amendment is particularly evident.How to correctly understand the value of legal license system is the most important issue to resolve the legislative dispute in the legal permission system of our country.This paper has three parts:the first part,the legislation and implementation of the first in China's copyright statutory license system at the present stage,respectively,significance,theory and Research on the statutory licensing system of domestic and foreign scholars views on issues related to the review;secondly combining guidance in specific cases to the Supreme Court judgment,legislation defect and loss of function leads to the current value of the statutory licensing system;related concepts to clarify again.The second part,the implementation of new environmental challenges faced by the analysis of the third copyright law amendment and the current statutory licensing system,trying to start from the statutory licensing function itself and the value of its legislative intent to radically reform,and summed up the crux of the problem.The third part,from the angles of legal permission scope,compensation mechanism and alternative system,combined with the domestic research status and theory and practice,puts forward some corresponding measures.
