Compared with other western countries, the damage of administrative monopoly to our country's economy is long and lasting. Administrative monopoly in China's different development stages of social and economic is in a different occurrence. It is closely related to the special period of our economic transition. And the happening and development of administrative monopoly in our country is more inevitably connected with our government's unfair administrative policies, local government's eager to pursue for short-term economic benefit, the neglect of consumers' rights protection, a lack of legal regulation and the whole society's monitoring mechanisms.This article analyzes the characteristics of administrative monopoly in the current display through to its abstractness, mandatory, concealment, and summarizes different manifestations of administrative monopoly in China's different development stages of social and economic, then discusses how to remedy the harm caused for our consumers, business operators and social economy development.First chapter of this paper basically introduces the basic concept, the basic characteristics and the relevant basic problem of administrative monopoly.The second chapter combined with our existing laws regulating for our administrative monopoly from law level and legal responsibility levels and summarizes existing problems and defects of law enforcement subject, law enforcement program, legal liability set to relief measures and the legal regulating administrative monopoly status quo.Chapter three analyzes related laws and regulations of Administrative monopoly in the transitional countries as representative of Russia and the developed countries' represent American administrative monopoly and put forward the suggestions for reference.The fourth chapter reliefs measures of the legal regulations on administrative monopoly and put forward improvement suggestions according to the defects of legal regulation from law enforcement subject, law enforcement program, legal responsibility setting of our country's administrative monopoly. |
