Study On The Administration Procedure Of The Urban House Demolition

Urban housing demolition is an unavoidable part of urban construction. It also plays a very important role in our country's development. However, there happened several events about housing demolition these years. There are two reasons. The first one is that our country's laws still lack rules about process of urban housing demolition, the other one is that the process of urban housing demolition is still not due.The new "Administrative statutes on imposing and compensating houses which are on the land of country" (promulgated on 1.21.2011) has made great improvement on "public interest", compared with "Administrative statutes on Urban house removal", but still need to be discussed on the process of urban housing demolition. While writing this essay, the author used the method which is called theory combined with exercise. By comparing the two statutes above and analyzing the process of urban housing demolition, the author hope to improve whether the administration process of urban housing demolition is due and legal.This essay is separated into five parts.In the first part, the author introduces academic situation of the study on the process of urban housing demolition. And she defines several important words such as "administration process", "due administration process" and "the process of urban housing demolition". The author also introduces her study method briefly.In the second part, the author discussed the essential theory of this essay, due administration process, such as the source, the basic meaning, the mode of judgment and several principals of the theory.In the third part, the author expounds the current situation of the process of urban housing demolition. She illustrates two examples and arranges the rules of the administration process of urban housing demolition.In the fourth part, the author analyzes the problems of nowadays process of urban housing demolition. The first one is lacking the process of judging "public interest". The second one is lacking process of public joining. The third one is the compensation process of deciding imposing urban houses is not fair.In the last part, the author raises several proposes about on due administration process of urban housing demolition. The first one is to establish the perfect process of judging "public interest". The second one is to set up different kinds of process of public joining. The third one is to make the information of housing demolition open. The last one is to establish a fair compensation process of deciding imposing urban houses.
