Global warming is becoming the world's environmental problems. In the choosing of economic model, from the original pattern of relying on a lot of energy consumption patterns shift to low-carbon economic path is consistent with international direction. Low carbon economy can achieve economic and social development and environmental protection at a win-win state, especially for the development of Chinese economy in transition has important significance. In low-carbon economy operation, to control greenhouse gas emissions, energy saving society as a whole to achieve mission objectives, emissions trading system has become an effective means should be selected.As a big country of consumption of resources, although temporarily need not to assume the "Kyoto Protocol" in the responsibilities and obligations to reduce emissions requirements, but based on great power responsibility to consider, still should take appropriate measures to deal with them. Emissions trading in China is still in its initial state, either formulation of laws and regulations related to the specific design of the system is compared with the practical experience of foreign countries are still somewhat immature. Based on this consideration, the paper aims to discuss and analyze the extraterritorial emissions trading system and concludes that China can learn from the experience of effective rule of law to China's Emissions Trading System.The first part of the introduction, writing from a global perspective of the purpose and significance of the low-carbon economy, domestic and international emissions trading system status and research status of the analysis and introduction, presented the overall idea of the article discusses the research methods and innovation.The second part related to a low carbon economy by definition, describes the strategic significance of low-carbon economy, while puts forward the elaboration and analysis done on the basis of the basic theory of emissions trading and describes the concept of related. The third part is about the basic of equity and efficiency of law, sustainable development and integrity and freedom of contract principle, from an economic point of view the interests of the game, and external analysis, and other entry points, on the emissions trading system for in-depth theoretical analysis.The fourth part talks about "the Framework Convention on Climate Change" and the "Kyoto Protocol " based on the value, combined with the European Union, the United States and Japan's regional experience, the emissions of international norms in the major countries and regions and relevant practical conditions.The fifth part in the discussion of the status of China's low-carbon economy at the same time, learns from foreign experience in the development of low-carbon economy, while China's emissions trading system to do the scene is discussed, and improvement of China's emissions trading system Legal thinking, as well as emissions trading system on additional consideration, the legal norms of our current system of norms in the absence of additional recommendations are concerned.
