With the continuous development of society, environmental problems are increasingly severe. In this case, the low-carbon economy is generated. Under this concept of low-carbon economy, Western countries have already adopted various measures. China has not only to develop economic and eradicate poverty but also to address how to reduce greenhouse gas emissions which is a very difficult task. Therefore, in the current strategy of maintaining growth, adjusting structure and promoting development ", the implementation of energy conservation, renewable energy, and promote low carbon economic development is the obvious solution. To construct the ecological civilization which is our goal. The methods of achieving a low carbon economy are first direct control, 2nd the carbon emissions and the carbon emissions trading tariff. Among these three methods, the 1st is a direct means of control which is too rigid and ineffective; the last two are indirect which provided some reduction flexible and suitable incentives by utilizing the market mechanism. Based on situation of China, we should commit ourselves on a low carbon economy as an important means of achieving carbon emission reductions of carbon emissions and carbon taxes in these two areas. With more emphasis on our government to control carbon pollution, and practice of world- wild carbon emissions trading, carbon emissions trading has begun to comes into public view. Meanwhile, along with some developed countries, via the legislation of carbon tariff, the relevant departments in China have already commenced the preparation. In the absence of relevant legislation our low-carbon process is very difficult. This essay will base on and carbon tariff law, studies and provisions from other countries and also base on the international carbon emissions, in order to give inspiration to the China's legislation.
