| The history of economic development of society is also the history of socialcivilization development. Human civilization is developed from agriculturecivilization into industrial civilization, and evolved into ecological civilizationafterwards. It is accepted that the modern ecology society is the main trends of socialdevelopment. The following trends promote a certain amount of legal systemadvancing with the new era, which including carbon emissions trade legal system.The study and practice on carbon emissions trade legal system is experienced, whichis worth China to learn from. China also has some successful practice on carbonemission trading, and carbon emissions exchange was established in pilot city.However, the developing pace of trading in China is slow with carbon emissions tradelegal system is missing. It is necessary to build and better the carbon emissionstrading system.Based on this point of build carbon emission trading system, this paper is writtenfrom the principle theory as the first part. The second part of the paper describes thecarbon emissions trading system abroad, including international and regional carbonemissions trading system. The third part of the paper is comprehensive analysis on theexisting condition of China’s carbon emissions trading. The last part is to form thelegal system with aspects as follows, philosophy, legal system, regulatory regime, andetc., and solve the legal problems existed in China, with an aim to build a carbonemissions trading system. |
