Research On Several Legal Issues About The Agricultural Export Subsidies In WTO

The Agricultural Export Subsidies under WTO Principle is the focus of benefit game of the countries, and it is till an obstacle of the agricultural free trade. The Agreement Subsidies and Countervailing Measures (SCMA) and Agreement on Agriculture (AA) have made some rules for agricultural export subsidies which are yet limited and the developed countries are still carrying out their agricultural export subsidies policy by different means. This thesis analyses some legal issues of agricultural export subsidies under WTO Principle and then makes some suggestions for China to cope with the issues of agricultural export subsidies.This thesis is composed of the following parts: Introduction. This part introduces the background, the main content, the current condition and some important relevant terms of the research. Chapter one mainly introduces the development of WTO rules of agricultural export subsidies. By the research in the way of development of agricultural export subsidies rules, this chapter summarizes the development characteristics of the rules. Chapter two is about the recognition of agricultural export subsidies. This chapter makes researches in the legal issues of the identification of agricultural export subsidies rules referring to quantification, criterion, and the differences among countries and so on. Chapter three is about the execution of WTO rules of agricultural export subsidies. This chapter analyses the execution mechanism of agricultural export subsidies such as the execution, supervision and remedy. The last chapter is about the standpoint and strategy of China on agricultural export subsidies. This chapter probes into the standpoint of China in Doha round negotiation as well as the strategy that how China uses the WTO dispute-settlement system to cope with the issues of agricultural export subsidies.
