Humanitarian intervention in international law has always been a controversial issue. All along, in the international community there are a variety of arguments not only for the concept and principles of humanitarian intervention, the theory of humanitarian intervention for the use of the practice of dealing with the consequences of international affairs, but also produced a variety of confusion and trouble. Therefore, we need to analyze the history of humanitarian intervention and analysis of humanitarian intervention from the perspective of principles of international law, then combined with relevant international practice, to point out the basic principles of humanitarian intervention and international law is lack of international legal basis .The thesis can be devided into three chapters. The first chapter is an overview of humanitarian intervention, that describes what is humanitarian intervention. This chapter introduces the concept of humanitarianism, and then introduce the concept of humanitarian intervention. Next comes the historical development of humanitarian intervention, by reviewing the history of development, humanitarian intervention for the following analysis is not unreasonable to pave the way for the legitimate place.The second chapter describes the Western theory and practice of humanitarian intervention and the difference in theory and practice between China and Western countries. The difference first because in the Western countries and China, there is differences in the international principles of international law, sovereignty and human rights. Second, the global strategic orientation is different between China and Western countries, and also the interests.The third chapter discusses the conflict of the principles of humanitarian intervention and international law. Theory of humanitarian intervention since its birth, has been controversial, theory of humanitarian intervention is also very unique. Many people have the wrong understanding of humanitarian intervention. The author discussed the conflict from three part, the international law principle of national sovereignty, the principle of non-interference in internal affairs, and the principle of prohibiting the use of force.
