Study On The Legal Regulation Of Government Investment Decisions

Government investment projects which aims to meet the social and public needs is an important part of total fixed assets investment projects.As the most critical part of government investment management system,government investment decisions not only determine whether the government investment projects can be smoothly carried out, but have significant influences on economic and social development.With the deepening of investment system reform, the government has made some achievements in government investment decisions, but in practice there are still many problems.In order to eliminate the faults ,at the same time achieve scientific and democratic decision-making which is the core and basic requirements, we must regulate and secure government investment decisions from a legal perspective.Legal regulation of the government investment decisions aims to support and bind the whole decision-making process by legal means.This paper is divided into four chapters,and discusses theoretical and practical issues of the legal system regarding to decision-making of government investment,then reviews government investment decisions on new perspective,and proposes advices to construction of the legal system for government investment decisions.The first chapter, contains the legal definition of government investment decisions. This chapter clearly defines the concept of government investment and government investment decisions and gives an overview of the characteristics of government investment decisions, indicating the necessity and urgency of the legal regulation of the current government investment decisions.The second chapter shows comparative analysis of the legal system of government investment decisions of developed countries. This chapter begins by emphasizing the comparisons of the legal system of government investment decisions of the United States, Germany, UK, Japan, and then summarizing advanced legislative experiences in the legal system of government investment decisions of developed countries.The third chapter, studies the current status of the Chinese government investment decisions. This chapter reveals the main problems of the status of the Chinese government investment decisions with an example of Yichang "Three Gorges Highlights" Demolition Project, and later analyzing China's current legal system of government investment decisions.The fourth Chapter outlines some construction ideas of the legal system of the Chinese government investment decisions. This chapter gives future prospectives and suggestions on the improvements of the legal system of the Chinese government investment decision-making with reference to the experiences of scientific and efficient of developed countries.
