| Shipping industry is characterized by its internationalization. In the condition of economic globalization and China's membership in World Trade Organization, we must learn the advanced legal systems in the world. Since the shipping competition laws of EU and USA are relatively mature and effective, study on the antitrust exemption in EU and USA.contributes to establishment of the antitrust exemption system of our country, coordinates the relationship between antitrust and scale economy and maintains the economic interests and public interests of our country.This paper contains four parts in addition to introduction and conclusion.The first part focus on the basic theories of antitrust exemption. Competition is the milestone and soul of market economy, but free competition leads to monopoly easily. Countries in the world strictly limit the monopoly. Considering the international shipping industry is special, laws of many countries allow the antitrust exemption.The second part introduces the present situation of the international shipping monopoly, puts the international shipping monopoly organizations into three categories, including liner conferences, discussion agreements and operational agreements. Meanwhile, it shows the impact of the theories about antitrust exemption on our country by analysis of THC event.The third part shows us the provisions of the shipping competition law of EU and USA about antitrust exemption, and analyzes the trends of the theories about antitrust exemption from the perspective of economic and industrial policy.The fourth part studys the shortcomings of provisions of legislations related to China's shipping industry and puts forward some suggestions for improvement of antitrust exemption system in China's shipping industry. |
