Research On Shipping Antitrust Exemption System Of Singapore And Its References To China

Ocean transportation is the most important mode of transportation for international trade,effective and reasonable shipping competition rules are conducive to ensure the sound development of the shipping industry.As an important part of the shipping competition law,the shipping antitrust exemption system is crucial to the development of a country’s shipping.However,China’s shipping economy is still not mature,and the international competitiveness of shipping companies is generally weak.China has no clear and specific provisions on the shipping antitrust exemption system,and there are obvious legislative defects.Singapore is a famous international shipping center,its shipping antitrust exemption system plays an important role in the development of shipping.Therefore,this thesis selects the Singapore section as the object of investigation,and studies the specific content of Singapore’s shipping antitrust exemption system,in order to inspire the construction of relevant systems in China.Except for introduction and conclusion,there are four parts.Chapter one is an overview of the shipping antitrust exemption system in Singapore.To study the Singapore shipping antitrust exemption system,we first need to explore the basic issues of shipping antitrust exemption.Therefore,this chapter briefly describes the theoretical basis and legislative status of the shipping antitrust exemption system.Then this part explains the current situation shipping antitrust exemption system in Singapore,analyzes the causes of the shipping antitrust exemption system in Singapore,introduces the legal regulations of the system and evaluates the system.Chapter two studies the general regulations of shipping antitrust exemption in Singapore.Competition Law as a general law to adjust the monopolistic behavior of all walks of life,of course,it applies to the monopolistic behavior of the shipping industry.Therefore,based on the Competition Law,this chapter specifically describes the nature,composition and responsibilities of the competition authority-the Singapore Competition and Consumer Commission and analyzes it,then analyzes the anti-competition agreement and its exemption in the Competition Law of Singapore.Chapter three studies the special regulations of shipping antitrust exemption in Singapore.Singapore has established an antitrust exemption system for liner shipping agreements by enacting the Block Exemption Order for Liner Shipping Agreements.Based on the Block Exemption Order for Liner Shipping Agreements,this part introduces the specific content and characteristics of the shipping antitrust exemption system in Singapore from three aspects in details,including the scope of exemption,conditions of exemption and cancellation of exemption,and analyzes them respectively.Chapter four discusses the references of shipping antitrust exemption system in Singapore to China Firstly,this part studies the current situation of China’s shipping antitrust exemption and points out the defects of China’s relevant legislation.Secondly,this part analyzes the significance and principles of the shipping antitrust exemption system in Singapore for China on the basis of the previous article.Finally,this part takes the revision of China’s Regulations on International Maritime Transportation as the starting point and puts forward some suggestions on the issue of China’s shipping antitrust exemption system from the aspects of clearing the regulatory agency,clarifying the scope of exemption and refining the exemption conditions,with a view to establishing and perfecting China’s shipping antitrust exemption system.
