Study On Legal System Of Crew Social Security

Social Security System is a great progress in human society, it enhans social protection of human equality and social justice, maintaining social stability and promoting social development. Social security system is consist of social insurance, social welfare,social relief, special care and placement and social assistance. Social insurance, social welfare, and social relief are the main part of for crew social security system. "People Crew Ordinance" (since September 1,2007 shall come into force), this Ordinance involvs the rights and obligations of the crew,but most of its regulations are for the crew management requirements. "Social Insurance Law of the PRC" will be implemented in July 1,2011, and making the social security system for workers on land. Social security of land-based workers in China continue to imrove,However the crew of the social security system at sea doesnot have a corresponding development in practice, Social security system for crew at sea is established by reference of that for land-based worker.Because of the special nature of the work crew, the standards of land-based crew of workers can not fully protect the interests of the crew at sea. To setup a special social security system for crew at sea,according to their special work environment,is the key to long-term development of maintime in dustry.In view of this, the paper will be divided into five chapters on social security of the crew to be discussed,Chapter 1 summarizes the main social insurance and commercial insurance characteristics, and the similarities and differences between the two; Chapter 2 introduces the crew of the International Labour Organization on the status of social security legislation; Chapter 3 describes the crew of China and Japan on Social Security Legislation and its reference to China, mainly from the crew of old-age insurance, medical insurance, industrial injury insurance, unemployment insurance to be addressed; Chapter 4 discribes employer and the labor units, labor contracts and labor contracts as well as the counter meascures of disputes, and to our country the crew social insurance disputes exist the corresponding countermeasure is put forward; Chapter 5 is the focus of this thesis based on existing 3 types of social security, respectively, the corresponding legislative measures will be interpretes proposed, and the crew of the social welfare and social assistance have also been a corresponding interpretation.
