The Predicament And Perfection Of The Legal Aid System

The legal aid system is the inevitable outcome of human's legal civilization when they develop to certain stage. It is a widely-adopted way in most countries. Its institution is one of the symbols that a nation pays respect to and attaches importance to human rights.Chinese legal aid system has obtained certain development since China developed legal aid experimental unit in 1994,become indispensable organic component in Chinese legal system, and played more and more important role in national political, economic and legal field. But as a new system, it has also suffered many difficulties and problems, such as distemper ness of legal system, the inner legal relationship of it, the boundary of target receivers, the inadequacy of its funds. The solution of these difficulties and problems depends on maturity of legislation, perfect of system.This paper, by analyzing problems of legal aid system in Chinese running process, with a view to value goal of constructing legal aid system that suits Chinese situation, tries to make deep discussion on drafting the Law of Legal aid, specifying the boundary of the receivers, providing adequate funding, expecting do some favors to Chinese legal aid system.
