Research On The Present Situation And Development Of China's Criminal Legal Aid System

Criminal legal aid system is an important part of criminal procedure system. It is of great significance to safeguard legal rights of criminal suspects and defendants, implement the principle of respect and safeguard human rights, and safeguard judicial justice. It is also increasingly becoming one of the symbols to measure a country's level of the rule of law. In our country, the criminal legal aid work started late, but it has been developed rapidly in the last twenty years, and it has made great progress. The criminal procedure law in 2012 made significant modifications to criminal legal aid system, it expanded the scope of object of criminal legal aid, and put the time of criminal legal aid in advance. The changes bring opportunities to criminal legal aid system and the development of the work, but it also brings new challenges and new requirement to it. In addition, after the introduction of new criminal procedural law, what are the changes in China's criminal legal aid work development, and what new problems happened, these are all for us to examine. Therefore, this paper based on the development practice of our country's criminal legal aid work, data collection and analysis. The paper summarizes the two decades development situation of our country's criminal legal aid work and it want to find changes of the criminal legal aid work after the new law implemented. At last, the paper is trying to make some advice to the development of criminal legal aid work. This thesis is composed of four parts:In the first part, I work with data and charts to analyses the current situation of the criminal legal aid work. First of all, I introduced the overall situation of the development of the legal aid work in China. Secondly, I analyzed the current situation of the development of criminal legal aid work in China before or after the implementation of the new law.The second part is mainly about analysis of the problems that exist in the new law implementation process. I focus on analysis of the cohesive mechanism and quality security problem of criminal legal aid work.The third part is about the content which is modified by the new criminal procedural law. In this part, I introduce these new contents and changes, including the law expanded the scope of object of criminal legal aid, and put the time of criminal legal aid in advance, etc.The fourth part is about introduces of the extraterritorial criminal legal aid work legislative model and implementation model, and I analyze the reference in the criminal legal aid of our country from the outside theory of experience.In the fifth part, I put forward some suggestions to perfect the criminal legal aid work. These suggestions include strengthening the propaganda of criminal legal aid work, increasing investment in criminal legal aid funding. It also includes perfecting the cohesive mechanism and quality security of criminal legal aid work.
