The modern spirit of rule of law focus on controlling powers through procedural law.China's relevant laws on administrative legislative procedure,compared to the past,is more feasible and democratic.In particular,mechanisms of public participation reflecting the legislative democratic developed rapidly in norms and practices.However,the current administrative legislative procedure has a large gap to ensure the quality of legislation and legislative justice.Compared with the growing public interest demands for participation in the legislative,there are still a big gap too.The purpose of this essay is to show the framework of public participation through the introduction and comments of administrative legislative procedure between the two states on theory and practice.Administrative Procedure Act is the core specification of U.S.administrative legislative procedures.It is more complete and detailed than other nations' legislation in the legislative initiative,planning and drafting legislation,legislative information public,legislative hearings and other sectors,we can learn a lot from its practices.
