Major administrative decisions are the administrative decisions made by the government decision-making organs to adjust the complex overall social activities in accordance with the law.In the new era,social reform has entered a deep-water zone,and the realization of major administrative decisions largely depends on the support of the public,which mainly depends on the protection of public participation rights by law.Ensuring the right of the public to participate in major administrative decision-making procedures can enhance the public's recognition of policies and support for decision-making,and promote the construction of a consultative democratic society.Therefore,the author focuses on the issue of public participation in legal proceedings.This paper is divided into four parts.In the first part,the author first defines the concept of major administrative decision-making,distinguishes the differences between major administrative decision-making and general administrative decision-making,and distinguishes the differences between the subject of public participation rights and the administrative counterpart,and defines the "relevance" of stakeholders,studies and analyzes the inevitable embodiment of the democracy of public participation in major administrative decisions in the administrative legal process.In the second part,the author studies the current situation of public participation in major administrative decision-making from two dimensions of legal norms and social life practice.This paper analyzes the relevant procedural laws and regulations,analyzes the problems of insufficient awareness and rationality of general public participation in social practice,organizational construction of public participation,inadequate disclosure of decision-making information,unclear scope of application of public participation,flaws in decision-making hearing procedures,the lack of feedback procedures and the defect of right remedy.In the third part,the author makes a comparative analysis of the advantages and disadvantages of therelevant systems of public participation in major administrative decisions in foreign countries.In the fourth part,the author perfects the participation procedure from the perspective of different types of events.We should improve the legal procedures of public participation in major administrative decision-making from the aspects of the organization of public participation,the disclosure of decision-making information,the hearing of decision-making,the right relief of participation,and the investigation of legal responsibility.
