Research On Problems Of Land Contract Management Rights Transfer (Inheritance)

Rural land contracting right succession, it is a relatively complex issue both in theory and in practice. At present, the right to land contractual management succession disputes occurred frequently in the vast rural areas. Since the principle of legislation too, and no reference to judicial interpretation, and the sentence is very difficult like this case for the court.Whether the right to land contractual management can be inherited, how to inherit, inheritance way, and so on. The courts are not available for reference in the law. How to solve this problem is a priority. The author is based on the current situation, from the practical point of view, by Liwei Xiang and Li Gemei discussion of land ownership dispute case, analyzed the legal issues involved in this case.This paper briefly describes the basic facts about Liwei Xiang and Li Gemei case of land ownership disputes and the trial results. Then, it leads to the focus of controversy in the proceedings in the case. On this basis,from the practical point of view emphasizing on the right of rural land contract and management issues related to inheritance. On whether the right to land contractual management in rural areas can be inherited, the heir to land contractual management right to determine the scope, the right to inherit land contract management principles and methods and so on are described. Finally, the author summarizes the case made on the basis of gaps in our laws and proposed countermeasures to look forward to future proceedings on the substantive help.
