The inheritance of the land contractual management right haven’t been clearly defined, legislative exlanation, practice and academic practice is not consistentand and there are many aspects to be discussed. In this paper, through empirical analysis and interpretation theory, demonstrate when inheritance occurs the owner of land contractual management right transfer from the " Peasant household" to "the individual”;the property attribute,transferability,the social security function of the land contractual management right,and come to the conclusion: the land contractual management right belonging to the" rightful personal property when citizen die,it should be recognized that the land contractual management right can be inherited.
