The Study On The Transfer Of Rural Land Of Typical Pattern And Legal Dilemma

The reform of rural land system is the important guarantee of China's economic sustainable development and also the key to solve"three agricultural problems". With the guide of China's rural land reform, which has been on for more than 30 years, China experienced the transition of planned economy system to market economy system. And with the furtherance of market economy reform, the current land using system–"household responsibility system"cannot liberate labors effectively and cannot improve production efficiency any more, for the gradual exposure of its inner defects, which has been an obstacle to China's rural economic and social development. Therefore, promoting rural collective land circulation and developing agricultural scale management gradually are the cores of rural land reform. From the perspective of promoting rural market system reform, agricultural marketization and industrialization and with theoretical studies, this paper macroscopically focuses on the legal dilemmas in the course of rural land circulation, explores system innovation to strengthen land management and guarantee interests of peasants under the backgrounds of Rural-urban Integrated Planning, improving rural social insurance and urbanization.The full text is composed of exordium, chapter 2-4 and conclusion.The exordium is an introduction to the background of rural land transition and the practice status of China's land transition. It summarily shows the motivation of rural land circulation and the legal systems which need to be perfected, and points out the practical significance of this study.Chapter 2 is a summary of China's rural collective land circulation. This chapter is divided into two points: the scope of China's rural collective land and the historical evolution of rural collective land ownership; the theoretical basis of China's rural collective land conversion. It shows that rural collective land circulation is the inevitable requirement of China's rural economic development and it accords with economic development's objective law in this chapter.Chapter 3 discusses the typical models of China's rural land circulation.
