Research On Court System Reforming In China

Court system has achieved great success since reforming and opening policy carried out, and formed elementary Chinese characteristic system. However, problems are still exist, for instance, jurisdiction localized, court has too much administrative characters, judge popularized and so like. These problems have been and continuing to obsess Chinese justice. At present, China face its significant strategic age, construction of market economy, democracy and rule of law, all of these put forward high requirement for court system reforming. According with the judicial system reforming, it's an urgent problem requires deeply research and resolution to establish jurisdiction responds to practice. Break traditional situation that jurisdiction is totally superposition with administrative region, and set up special professional court, besides common courts, therefore become a main assignment of court system reforming. This paper thus insist on scientific developing view, analyzed existing problems and their causal of court system, combined basic condition in China, based on special function of Wuhan Marine Court, indicated that shall set up Circuit Court crossed administrative regions, and at meantime, pay attention to relevant resolutions, attempts to give constructive recommendation under the leading of CCP and constitution.
