Jurisprucdential Thinking On Some Issues Of The Supreme Court Circtuit Court

In December 2,2014,the seventh meeting of the central comprehensive deepening of reform leading group for consideration by the circuit court of the Supreme People's court set up "pilot program",and at the end of the month to start a pilot project in Shenzhen,Shenyang,decided to set up the first and the second circuit court,the fourth Plenary Session of the 18th CPC Central Committee established"optimizing the allocation of judicial authority",clearly put forward the "Supreme People's court the establishment of the circuit court,the trial reform of administrative regions across the major administrative and civil cases" and implement the.At present,the first and second circuit court has been operating normally,the other four cities will be set up in the circuit court,the court will be a comprehensive national coverage.This thesis consists of four chapters:The first chapter mainly discusses the purpose of the establishment of the circuit court,as well as the operation of the circuit court,the jurisdiction of the division and the scope of the case,the composition of the judiciary,the operation of the procedure to review the circuit court.In the second chapter,the author points out that the lack of legislation and the standards and procedures are not clear,and from the perspective of reality and ought to be the legal argumentation of the two chapter.In the third chapter,the author makes a jurisprudential analysis on the problem of the organization design and the judicial cost of the circuit court,and puts forward some design ideas for the circuit court in accordance with the above two questions.In the fourth chapter,the author analyzes the trial level system of the circuit court from the angle of jurisprudence,and considers that the trial level of the circuit court makes it inconsistent with the second instance trial system of our country,and thus causes some problems.The characteristic of this paper is that the topic is novel,the circuit court has great development prospect,at the same time,it is complex,and it is also the focus of national judicial reform.The innovation lies in paying attention to the reality and the consciousness of the problem,and puts forward some thoughts and suggestions on the future development direction of the circuit court.
