On Legal Protection Of Environmental Right To Know

People's survival and development are not inseparable with the environment. In people's whole life, they always think the relationship between people and the environment. Our life, learning and working are affected by the environment. Human's activities need environmental resources. Know and learning the information of environment is not only the human's natural properties need, but also human's independent, autonomous and freedom in the social relationships. After get environmental information, people are able to transform nature and society, realize their own survival and development. Can be said that the environment has been informed of the concept exists in our mind. Natural environmental right to know is a freedom for people.However, now in a democratic, rule of law and free country, environmental right to know is protecting by legal system. It is not simply a moral right of the natural rights system. There should be having three states of environmental right to know, which is due right, legal right and real right. Fairness and justice are good legal value of law. Legal protection of environmental right to know is to realize the value of people's pursuit of good legal value. But the legal system's construction and development is not easy, therefore, we need to improve the legal system.This thesis starts with a lead pollution event, pointing out that the problems of legal protection of environmental right to know in China. Then with an analysis with jurisprudence, clear the definition and connotation of environmental right to know, analyzing the nature and characteristic of this right. It will provide theoretical support for the legal protection system. Finally, we look for shortages of legal system, which including legislation on environmental protection, administrative protection and judicial protection. We analyze the reasons and get some recommendation to solve the problems. And we can learn extra-territorial's legislation and other desirable or useful experiences to perfect this right.
