According to humans'natural and social attributes that sharing rights of property, human rights is the embodiment of people's dignity and value. On a global scale, the concept of human rights has been widely recognized as an important thinking. The human rights theory which is the most important part of the socialism with Chinese characteristics has also been accepted by most people. Comparing with the hundred years of human rights'development history in western countries, the development of China's human rights law protection system needs to be perfected. In order to develop human rights, we must not indiscriminately copy western patterns of human rights; we should establish a human rights protection system suited for China's national conditions so as to realize the full liberation of the people. As a pioneer of the proletarian revolutionary theory of Marx, his thoughts which based on the development of human rights in China have great theoretical value and positive guiding significance.From the perspective of Marx human rights philosophy, the author stands on the thoughts of Marx human rights, analyses the development course of human rights, discusses four aspects on making criticism of modern human rights and giving enlightenment of China's human rights development, reveals that the thoughts on Marx human rights is the solution of modern human rights theory."Any right cannot surpass the social economic structure and social cultural development that restricted by the economic structure."In the process of constructing socialism with Chinese characteristics, we should acknowledge the utility value of human rights, establish scientific concept of human rights, construct socialism with Chinese characteristics of human rights system and finally create conditions for achieving the ideal of human liberation.
