Countermeasures Of Intellectual Property In China In The Context Of TRIPS Agreement

As the development of the capitalist commodity economy and as the further development of the international trade and economic globalization, the intellectual property trade have become more and more important in the international trade. However, every country don't protect intellectual property in balanced level, because of the regional nature of intellectual property. In the case of this contradiction, major developed countries conclude the Agreement on Trade-Related Aspects of Intellectual Property Right which formed intellectual property protection system in the world. In the TRIPS, the features of international protection of intellectual property rights is the wider range, more severe measures, higher standard, which change the protection methods of intellectual property and establish a series of new system and standard. But,from the history of international protection of property rights, we know the developed countries draft the modern protection system of intellectual property while the developing countries only passive accept. The system international protection of intellectual property rights which represents developed coutries'benefit inevitable exist some defects. The high standards of this system weakens the developing countries'legislative sovereignty and increase the cost of economic development. In this case, we must research strategies, improve the system international protection of intellectual property rights, and strengthen the capacity of knowledge innovation.This article discusses the content,function,basic principles of the international protection of intellectual property rights in the TRIPS and problem and challenge of international protection of intellectual property rights. It further analyzes the status of the intellectual property rights in China and the international protection of intellectual property rights cause effect for our country. Then it finds the problem of the protection of intellectual property rights in China and propose some solutions for our country's protection of intellectual property rights.This thesis has 5 major parts. In the first part, it introduce academic and application significance,research status at home and abroad. The second part discuss the concept of the international protection of intellectual property right,its basic principle and history. The article also illustrates the problem and status of the protection of intellectual property rights in the world. The third part explains the problem and status of the protection of intellectual property rights in China. The fourth part introduces the effect which the international protection of intellectual property rights cause for our country. In the fifth part, it propose some solutions for our country's protection of intellectual property rights.
