Since the nineteenth century, with the rapid development of science and technology and the increasingly frequent international exchanges, international protection of intellectual property developed very quickly. This international exchange made their own intellectual property achievements out of the territory. The State coordination and cooperation is imperative, and gradually became the international hot spot. Currently, According to statistics, the global international intellectual property treaties reached 30, involving all aspects of intellectual property rights, forming a huge legal system. Among them, the Agreements on Trade-Related Aspects of Intellectual Property Rights (TRIPS) are already and the most influential international treaties of the highest level of protection. Although because of a variety of historical reasons, from an overall point of view, construction of the Chinese intellectual property system began rather late, and there is a larger gap with countries around. However, for the needs of reform and socialist market economic development, and to promote the world economy and China's accession,we became a number of the World Trade Organization. Based on TRIPS agreement, our intellectual property construction has accelerated the pace and has established a relatively complete legal system for intellectual property protection after several amendments and has made remarkable achievements. Our protection of intellectual property standards has reached a new level.This essay is divided into four parts. The second part is about legislative protection of intellectual property rights in our country. The third part analyzes amendments to the intellectual property laws in our country in line with the TRIPS agreement case. Finally, looking for the gap between the TRIPS agreement and our existing intellectual property legal system based on the above analysis and come up with strategies.
