Economic globalization develops,followed with a sweeping global trade liberalization,^ the background of the economic development,the countries in the world will develop vitality, and thus at the stability of the development,the countries have begun to focus on the pursuits that have been neglected when simple pursuing economic growth. Such as the environments, labour rights. At the beginning of the workers'rights protection, it has a strong domestic color, the international community have recognized it as a international law principles,every country has the supreme rights to protect its own labors. But the economic interests have an influence on the domestic legislation.Blue trade measures reflect this trend,and it can be said that the protection of the workers'rights have linked with the international trade. We try hard to get a international standard to the protection of labours'rights.Not only the the Organization for Economic Co-operation and Development but also the International Labor Organization pay attention to the labour standards.The WTO has been concerned with it too.The international community has been made suggestions to promote the protection of workers,including to formulate unified labor standards and to link it with trade sanctions.This paper is mainly based on a thorough analysis of blue trade measures, the first part generalizes the meaning,the characteristics and forms of the blue trade measures,introduces its historical evolution, analyzes the value of blue trade measures, explain the cause and the negative influence of blue trade barriers, compares the blue trade barriers with other new trade barriers,analyzes the relationship between the blue trade measures and the blue trade barriers,so caused us to pay enough attention to it,thus to take the right measures to solve problems in the blue barriers. The second chapter introduces the legislation regulation of the international community about the labor rights protection, it is the basic of the developed countries implement the blue trade measures, including the World Trade Organization, the International Labor Organization and various social forces. The third chapter discusses the Legislation practice of the main countries, including the European Union, the United States and India, and then summarizes their inspiration to China, also,this will give us the theoretical and practical basis on which we can improve the level of our own labours'rights. The fourth chapter clarifies the opportunities and challenges that the blue trade measures bings to China, the influence to the labor legislation.Finally the fifth part from two aspects to summarize the suggestion of legislation,the international and the domestic, in order to deal with the blue trade barriers.Then from the angle of enterprises and trade associations to find out the legal strategy to cope with the blue trade barriers.All in all,we must obsord the advanced experiences of the foreign countries, actively improve the related regulations, gradually get touch with the international core labor standards, it can not only benefit to our domestic labor relations,but also can reduce the friction of international trade.So we can set a good image in the international community.The innovation points of this paper is through the comprehensive discussion on the blue trade measures,then clarifies the relationship between the blue trade measures and blue trade barriers, this paper comparises the labor standards of international organizations,the main countries and folk groups, take a comprehensive look at the blue trade measures, it has not only positive influences but also negative effects, we can finally find out the strategies to deal with the blue trade barriers.From two aspects:on the one hand, we must put forward the countermeasures which can breakthrough blue trade barriers that the developed countries set, clear the attitude in dealing with blue trade barriers;on the other hand, our country should improve the domestic legal system,to build our own blue trade measures, not only passively response, but aslo actively defend our rights, make use of the legislation, the enterprise itself and the industry association must take an active role in it.
