Legal Protection Of Rights And Interests Of Peasant Laborers From The Perspctive Of Social Equity

The peasant laborer in our country is the transitional social stratum which rural population transforms to the city peoples. They come from the countryside to the city in order to engage in the industry, the trade and other non-agriculture occupation in the city, making their inestimable contribution for the urban development and the prosperity. If there were not peasant laborer's industrious work, the city and the resident lives couldn't work normally. But because of various factors, the peasant laborer is treated unfairly in urban many rights and interests, which realize difficultly their rights and interests to fairly.In order to protect the peasant laborers' rights and interests, the academic circle proposed many kinds of mentalities, which all made sense. But the author believe that protecting the peasant laborer through the legal way is vitally practically significant, which also causes the protection of the peasant laborer to land on feet, and gets up the goal of protecting earnestly the peasant laborer's rights and interests.This article take the social equity as an angle of view to: investigate realistic situations of our country peasant laborers, such as personal rights, right to work, political right, social security right and education right; carefully analyse the reasons, which causes our country peasant laborers to suffer the unfair treatment in above rights; based on careful analysis to the present situation of their rights and interests'protection, propose the feasible plan that protects the peasant laborer rights and interests through the legal way.The article altogether divides into six parts: First part is the introduction, which relate mainly this article research origin, the related literature, the research mentality; In the first chapter, the social equity, as the foundation of this article issue, has been carried on document's the broad elaboration, and a word"the peasant laborer", as this article core concept, has been defined; The second chapter has described the peasant laborer rights and interests' present situation with positivism's research technique, by which, the people can see peasant laborer's various unfair treatment in the city life; The third chapter has presented the present situations of our country peasant laborer rights and interests' legal protection, by which, the people can understand the necessity to strengthen the peasant laborer rights and interests'legal protection; The fourth chapter has carefully analysed the reasons, which causes our country peasant laborers to suffer the unfair treatment, which was the premise to propose the legal protection countermeasure to the peasant laborer's rights and interests; The fifth chapter has carried on the protection countermeasure to the peasant laborer's rights and interests mainly from many levels, such as legislation, judicature, law enforcement and legal help, and to establish a set of complete legal protection system of peasant laborer rights and interests. This part is the key part of this article. Meanwhile in the fifth chapter, the author has also proposed the multi-level protection strategies, which coordinate with the legal protection together to achieve the goal to protects the peasant laborer rights and interests effectively.
