Space launch program can be described as a very risky campaign as well as technical activities with tremendous costs and risks. Recently, with the development of space technology, more and more private entity started to join in this kind of activity. In order to protect the right of these joiners,"space insurance"exists.In this paper, first I analyze the special characters of"space insurance"by studying the purpose, type and contact of it. The conclusion is that,"space insurance"is mandatory and affects the benefit of the government. Because of these specials, the legislation of"space insurance"is not very excellent, that makes the practices of commercial space activities very hard.A legislative basis has already been established for outer space insurance by the provisions related to outer space insurance in international and national outer space legislation, and leading space countries have established a preliminary legal system for outer space insurance on the aforementioned basis. Revealing the merits and defects in the provisions of outer space insurance existing in international and overseas space legislation through further analysis will find that the provisions in treaties are principle and the national legislations are not the same to each other, which will hinder the cooperation of different states. So it is necessary to take actions to complete the legislation of space insurance.On my view, it is possible to make international laws and institutions to promote cooperation. At the meanwhile, as a leading space country, how should China -- in the circumstance without outer space legislation -- get properly acquainted with the trend of international society, use the space legislation of leading space countries for reference, fulfill its obligations in international society and strengthen its cooperation with other leading space countries through legislation, all of which will offer certain hints for determining the contents of outer space insurance in China's space legislation in the future.
