The Study Of Legal Problems In Banking Practice Of The Pledge System On Accounts Receivable

Property Law of PRC made a new method of financing which is the pledge of accounts receivable. The main purpose of the pledge system on accounts receivable was to make our country being leaved idle and a huge amount of receivables can be able to pledge to bank loan, and reduce bank risks. Although real estate mortgage and guarantee loans accounted for bank loans the proportion of amount is large, but these two methods have fatal flaw in banking practice. The former embodied in state-owned land access mortgaged by conditions, the latter is to guarantee the loan relatively loan guarantees there exist deficiencies. However, the system of account receivables pledge in Property Law is imperfection, with a great deal of shortages and in dire need of improvement. Therefore, how to reduce consummates bank risk at a system level and operational level, which has become an urgent need to resolve problems in banking practice of the pledge system on accounts receivable.This paper total is divided into three parts, research concentrates on solving and prevent receivables pledge in banking practice problems in the central issues to gradually develop. In chapter 1, combining the current our country commercial bank credit business practices of receivables pledge in banking practice described various existing problems and risks in this paper. In chapter 2 is extensive research related books, materials, paper, on the basis of analysis and comparison study method, on the one hand, from accounts receivable pledge legal system level to the above questions deep level of research and analysis, on the other hand to practice receivables pledge tripartite subject view, study practice various existing problems and risks. Finally, in chapter 3 as the core of this thesis, basic on two chapters in front narrated and analysed questions. According to accounts receivable pledge in practice on the problems and risks proposed perfecting Suggestions and countermeasures.Among them, the part of improvement suggestions and countermeasures, the author from legal system and commercial bank operation risk from two aspects statements. Legal system aspects including legislation style, registration system etc, to commercial bank operation risk are mainly divided into bank loan and credit, according to former after these two stages puts forward some new measures to prevent risks, to better promote the banking, financial innovation and business management, promote the steady development of our social economy.
