The legal dissolution of the labor contract is the main content of our country' s labor law. The labor law promulgated ten years ago and the correlative judicial explain have got behind the practice. They are not easy to be carried out in practice. My paper analyzes the legal conditions for dissolution of the labor contract of the labor law one by one, makes certain the meaning of the legal conditions for dissolution, comments the different judicial practices and the different standpoints, and puts my own standpoints. I think the legal nature of the work rules should be a stereotype contract. We should persist in the public notice principle and the reasonable principle when we constitute the work rules. I define the standard of the "severe" about the employer dissolution without notice, think the employer dissolution with notice be the same with the labor contract without term only, and introduce the payment substituted for notice. I give advice to improve the redundancy, introduce limitation of actions to restrict the legal dissolution of employer, give the employee compensation when the employee dissolve contract without notice, extend the extension of the dissolution without notice, the dissolution with notice of employee should be the same with the labor contract without term only, different employee should stipulate for different notice term, and add holiday to apply for a job in the notice term.
