As the gradual maturity of legal system in China and the improving of recognition to the value of life, people focus more and more on the phenomenon of students' being injured at school, but generally most of the study is on the dominant injury to the body, the other inhuman educational hurt—recessive injury is ignored. According to the behaviors, there are mainly mental injuries to the infant by humans such as teachers do physical or mental punishments to students, and some bad inclinations in our educational system. In this thesis, the author has a comprehensive survey on the phenomenon of infants' being injured recessively in the school context from the point of pedagogy,psychology and the science of law. The author analyses about the current situation of infants' being injured recessively, the reasons and tort responsibilities, then makes a suggestion on how to avoid injury from the angles of education and law, to make a new educational situation in which we can administer school and teaching with law, in which teachers and students respect each other's right.
