Information Privacy In The Network Environment And Its Legislate Protection

Along with the development of the information industry, the protection of individual information in the network environment is more and more important. A lot of countries and regions constitute laws to protect individual information privacy. Our country lags behind other countries and regions in this aspect. The author takes in the question, and intends to analyze the basal question of individual information, the existing protections of all sorts and their patterns in other countries and regions. On the basis of aforesaid analysis, combining the actuality about the individual information protection in our country, the author wants to seek after a way fitting the actuality of our country.The article can be divided into two parts, one is to discuss the basal question of individual information lengthways and the connection between individual information and privacy so as to catch the core of the question; the other is to compare other countries and regions' theories and legislations and find the similarities and differences or excellences anddisadvantages about the protection of individual information breadthwise. Via aforesaid analysis, the author looks forward to finding the insufficiency of individual information protection in our country and tabling a rational proposal for the intending legislation.The theme of the article is the investigation of protection of individual information. There are six chapters in this article, about 36 thousand words.Chapter one is the basal question of individual information and privacy. Based on expatiation of the definition, characteristic, extension of individual information, it analyzes the connection between individual information and privacy; get to the conclusion that the individual information still belongs to the privacy category. At the same time the author holds that the appellation of individual information privacy or information privacy should be adopted.Chapter two is the particularity about the tort and content of individual information privacy. The first section describes the specialty of the network and the new question brought about by it. The second section analyzes the content of individual information privacy. The third section is to explain the particularity of the encroaching about individual information privacy.Chapter three is the evaluation of the several existing protectionmeasures about individual information privacy ----- the technicalprotection measure, the contractible protection measure and the legal protection measure. The author analyses the three kinds of protection measures and points out the excellences and disadvantages of each respectively.Chapter four is the review of the other countries and regions' protection about individual information privacy. The existing protection measures of European Union, the U. S., Taiwan and Hongkong are introducedrespectively, and the excellences and disadvantages of the U.S.' s self-discipline mode and the European Union' s heteronomous mode are analyzed as well.Chapter six presents the readers with the -reflection upon constructing our country' s legislation about individual information privacy. Aiming at the actuality of individual information privacy protection, it points out that it' s essential for our country to strengthen the self-discipline protection, and the following action should be establish the position of privacy in the future legislation, and lastly the country should constitute specific laws to protect individual information privacy. To explain the question, the author arranges the constitution of specific law in an individual section, providing necessary explanation to the requirement of individual legislation, and its principles, the fundamental for individual data collection and adoption, and the essential content of the future individual information privacy law.
