On The Function Of China's Labor Union During The Transitional Period

The transitional period refers to the period when China's economic system turns from the planned economy to the market economy. During this period, a series of changes of the economic structure, the industrial structure and even the social structure have taken place. The state-owned assets and the worker identity withdraw from the state-owned enterprises successively. The non-public-own enterprises such as the foreign investment enterprises, the private enterprises, and the township enterprises develop rapidly. Correspondingly, the benefit pattern changes with the formation of different benefit clusters. This series of changes will inevitably cause the change of the labor union organizations. The reformation of the state-owned enterprises makes the working object of the labor union organizations turn to the non-public-own enterprises. The weak social groups composed of the laid-off workers with the employment difficult, people who have lost their jobs and people who come into city to seek for jobs become the working objects of the labor union organizations. The establishment of the new labor relations makes the labor union organizations take the effective harmonization of the labor relations as the main content of their job. This thesis expounds the function orientation and realization of China's labor union in the transitional period from four aspects. I. The General Introduction of China's Labor Union Organizations II. The Task of China's Labor Union in the Social Transitional Period The characteristics of the transitional period determine the new task of China's labor union. First, the labor union should take the expression and safeguard of the worker's legitimate rights and interests as the starting point and the basic principle of all labor union's work. When protecting the people's overall interests, the concrete interests of the workers should also be protected, especially the protection of the workers'legitimate rights and interests while deepening the state-owned enterprise reformation and establishing the modern enterprise system. Second, the labor union should focus on development to protect, to activate and to display the workers'initiation and creativity to the utmost. Meanwhile, the labor union should try its best to establish the enterprise and workers win-win pattern to establish the new labor relations through actively harmonization according to the characteristics of the transitional period. Furthermore, it should establish a sound labor relations three-dimensioned harmonizing system and the signing of the collective contract system through equal negotiation to promote the harmonious and steady development of China's labor relations. Third, the labor union should make accomplishments in respect of elevating the advanced nature of the working class and to establish the new-type working group. The adjustment of the industrial structure demand a new-type industrial army, so we should foster a skilled , expert working group to lead the elevations of the overall quality of the working class. Four, the labor union should make accomplishments in respect of the consolidation and enlargement of the class foundation of the CCP. The labor union organizations should shoulder the protective responsibility to quicken the pace of the establishment of the labor union for the non-public-own enterprises and to absorb the workers to this organization as many as possible. Fifth, the labor union should make accomplishments in developing the socialist democratic politics. The labor union is the important component part of the socialist political system, so it must represent the workers to take part in the management of the country, of the social affairs and of the enterprises and to carry out the democratic supervision. Under the leadership of the CCP, the labor union should try its best to represent and to protect the legitimate rights and interests of the works. III. The Function of China's Labor Union in the Transitional Period The basic responsibility of protecting workers'legitimate rights and interests are determined by the nature and characteristics of the labor union. It is also an important embodiment of practicing "Three Representatives"and the foundation and path of the labor union to obey the general interests of the nation and the CCP. According to the characteristics of the transitional period and the task of the labor union during this period, the labor union should perform its protective function from the following aspects: (I) To protect the workers'master position in politics and democracy according to the law. The labor union should ensure that the working classand the populace execute the rights of managing the country, the economics and the social affairs. This is the basic demand of the socialist democracy. The employees'assembly is the basic system for China's enterprise workers to participate in the democratic policy decision, democratic management and the democratic supervision. It is the basis for the working class to be the masters in national economics, politics, culture and the social life. (II) To protect the economic interests of the workers, to strengthen the construction of the labor relations harmonizing system and provide the steady social environment for the reform and development. The economic interests are the basic interests of the workers. In order to protect the legitimate interests of the workers, the labor union should above all protect the workers'economic interests. The labor union is the product of the social economic conflicts, especially the labor relation conflict. Where there exists the labor relation conflicts, there is the labor union. China's labor union is the mass organization of the working class under the leadership of CCP. It takes the governmental interests, the enterprise interests and the workers'interests into account, harmonizes the labor relations and to protect the legitimate rights and interests of the two sides of the labor relations. It is the labor union organization's responsibility to promote the harmony and stability of China's labor relations. (III) To fully display the main force role of the workers and to lead, protect and display the workers'initiation and creativity. The contact object of the labor union is the worker---the extremely active and key factor. The work of the labor union should focus on stimulating and activating the initiation and creativity of the mass workers, to promote the full development of the economics and the society. The labor union should basically realize and protect the workers'interests through development. First, organize the workers to carry out the mass-natured technological innovation activities. Second, elevate the scientific and the cultural quality of the workers. The labor union should cultivate a skilled, expert worker group to lead the elevation of the overall quality of the working class and to adapt to the need of the adjustment of the industrial adjustment. (IV) To continuously strengthen the reformation and construction of thelabor union organizations themselves and thus to ensure the performance of the basic responsibilities. The self-construction of the labor union includes two aspects: on the one hand, consolidate and enlarge the class foundation of the CCP. Since the implementation of the open and reform policy and the development of the socialist market economy, the foreign-invested enterprises, the private enterprises and the township enterprises develop rapidly. The worker's group also develops rapidly; on the other hand, strengthen the construction of the leader group of the labor union and try to construct high-quality labor union leader group which performs the routes, policies of the CCP, loves worker's movement, closely relates itself with the mass workers and dares to speak for the interests of the workers. It should be reliable in politics, masterly in its profession, reasonable in structure and always walking in the front row of the epoch. IV. The Problems and the Suggestions for its Solution in the Process of the Performance of the Functions of the Labor Union Since the establishment of the new working system of the labor union adjusting to the new situations has not been worked out, the labor union still work according the method and working system during the planned economy period. This makes the labor union encounter many new problems among the reforming enterprises and the non-public-own enterprises, for example, there exists the removal of the labor union in the reforming enterprises in the process of the state-owned enterprise reformation and the labor union president becomes a many faceted person who shoulder several posts. The labor union's assets and expenses are being misappropriated. The labor union members of the reforming enterprises are decreasing day by day. The non-public-own enterprises have the difficult to establishing the labor union, let alone protect the workers'legitimate rights and interests. The nowadays method and system is far from capable of solving this kind of problems. This makes the labor union's work scarce and powerless, which greatly hinders the realization of the labor union's function and the development of the labor union's work.
