With the rapid growth of world economy integration, there is more and more exchange of economy and trade among various countries. In the frequent trade activities, intellectual property is playing increasingly important role. Under the conditions of the united world economy and the free trade, intellectual property is one significant instrument with which the enterprises in the different countries compete with one another. With the improvement of the intellectual property system, an authorized patent represents a share of market, that' s to say, the control of a patent means the control of a market share. The enterprises, which have the advantage of intellectual property, are always more competitive compared with other ones. In order to obtain the larger market share and make more profits, the enterprises all over the world invest more and more capital in the field of intellectual property which gives rise to international and fierce competition for intellectual property. So do the financial circles which are regarded as the core of the modern economy. The financial patent, especially the business method patent in the financial field has become the focus of the competition for intellectual patent. In 2002 it was revealed that City Bank applied for the business method patent in China, which sounded the alarm to the Chinese banks. Currently, as for the recognition of the financial patent, and the application for and the enforcement of the patent, the Chinese banks will have to go a long way to catch up with the foreign capital banks. The Chinese banks will undoubted encounter the patent barrier which will absolutely hold back their own competitive strength.
