The Policy Analysis Of Land Expropriation Compensation

After a careful review and detailed evaluation of the land expropriation compensation, a lot of problems exist and should be taken immediate reformation in our present land expropriation compensation. Through a theoretical sum up of land expropriation compensation in foreign countries, it is found that the land expropriation compensation should be based on the land market price. In addition, the land expropriation compensation in China is different from other countries in that the duality policy of city and country separation makes the government give land compensation to the farmers and provide social insurance for them as well. At present Zhejiang is one of leading provinces on the reformation about land expropriation policy. This paper, based on the study and evaluation of the reformation in the land expropriation compensation policy in Li Shui, summarized the reformation experience which benefits the land expropriation compensation reformation throughout the country. Also this paper put forward suggestions and the scheme in land expropriation compensation policy and analyzes the difficulty in practice.The land expropriation compensation policy should follow the principle of equity and justice. In the present the reformation methods are as follows: (1) land expropriation compensation is composed of the compensation of land use right and land property. (2) As to the fees of compensation of land use, the present land patterns and time expropriated should be taken into consideration. The fees equals to the rent produced by land use. The wild land compensation should refer to the plowland compensation standard while the expropriation resulted in destruction of utilized land should be recovered or compensate the amount of money that could make it recovered. If the expropriation destroy the land and could not be recovered, the land property can be regained according to the related rules or be compensated.(3) If the land property of the farmers are expropriated, they could be compensated by the market price of farmland and given social insurance.
