Researches On Criminal Judicial Assistance Basing On The United Nations Anti-Corruption Convention

Nowadays, the global countries have reached the common realization:" the corruption is no longer a partial problem, but a kind of transnational phenomena, which has affected all societies and economies. So, it is essential to launch the international cooperation to prevent and control the corruption. "The 58th United Nations General Assembly had passed the first anti- corruption convention, the United Nations Anti-Corruption Convention. After the convention coming into effect, it will improve the international environments of the anti-corruption struggle, and make the most rampant corrupt form in publicly-owned and private field a criminal action, The convention will contribute to every member state to enhance their cooperation, in the filed of striking corruption, and will has significant meanings to the developing countries that are deeply suffering from the corruption. However, it is not necessarily the case that our country' s struggle against corruption will go smoothly from then on, because many contracting parties may prevent their own legal system from being revised by all means, in order to safeguard their national interests. This situation may result in a lot of protective items and elastic items in the convention. So, if we want to enable the struggle against corruption to make greater achievement, at first, we must consult the request of the United Nations Anti-Corruption Convention and enhance the domestic anti-corruption legislation and enforcement, utilize the international environments created by the convention, and obtain the cooperation of the international community, so that our country' s struggle against corruption could make greater result. Because of this, this thesis sets out from the background, content, meaning of the convention and states the author' s own opinion on the international criminal judicial assistance in the transnational anti-corrupt ion struggle. The author hope that Chinacould regard the convention as a good opportunity and achieve the best social effect and legal effect by means of improving the international criminal judicial assistance and enhancing the anti-corruption work in the new period.
