The Present Situation And Improvement Of Wildlife Protection Legislation

Wildlife is an active and appealing component in ecosystems. Wildlife is most important part of environment of human being, and it also plays important role in natural resources. Wildlife is valuable heritage of human being. However, the value of wildlife also depends on the viewpoint of human being, of which the economic interests of human make a great weight. Human society can not survive without wildlife, however in the past, now or in the future.Today, wildlife protection has been increasingly emphasized by all countries in the world. It has become a problem needed resolving urgently that how to realize the harmony of wildlife protection and development so as to avoid the serious relation between human and wildlife in the course of economic development. According to experiences of other countries, law with harshness punishment was very effective in countermeasures adopted to resolve wildlife protection problems. It has become an international tendency to attach importance to the pole law played in wildlife protection in the world. At the same time, some international organize has begun to have a deep study on the international wildlife protection legislation, and made every efforts to incorporate it into the international meeting resolution and multilateral treaty. The theory of wildlife protection has been long standing in Chinese ancient culture. Nowadays, there are some problems need resolving in present' wildlife protection legislation in our country.From the view of the practice of wildlife protection, the practical problem and legal defection are present in the paper confronted by the wildlife protection. At first, the feasibility and necessity of resorting to law in protect wildlife was theoretical analyzed in this paper, then the author dwelled on the situation of wildlife protection legislation in China. Secondly, the difficulties of wildlife protection legislation and legislative principles were analyzed. Thirdly, the author interpreted the urgent need tostrengthen the law in wildlife protection cause. At last, the present situation of wildlife protection legislation in China was dwelled on, as well as that, some advice was put forward. Series of legal solution are provided about the conflict between wildlife's living right and human's living right and property right, the treatment of wildlife and the compensation of the damage after its damaging. Several legislative suggestions are also put out in the article. The author expected it would be helpful to improve wildlife protection legislation and wildlife protection cause in our country.
